How Court Jurisdiction Works

Which Court Will Hear Your Case?

Scotland’s family cases — divorce, arrangements for children, financial provision, protective orders — are dealt with overwhelmingly in the sheriff courts, the local courts organised into six regional sheriffdoms. Which court hears your case is decided by geography, not choice: proceedings are normally raised in the court serving the area where the parties live, usually where the person the action is raised against is based.

Court reforms over the past decade consolidated Scotland’s court estate, so several towns’ historic courts — Cupar, Arbroath, Haddington, Kirkcudbright and others — no longer sit, with their business absorbed by neighbouring courts. The catchments below reflect the current, post-consolidation map, verified against Scottish Courts and Tribunals Service records.

What about the Court of Session? Scotland’s supreme civil court, in Edinburgh, hears only a small minority of family cases — typically the unusually complex or high-value — plus appeals. For almost everyone, the sheriff court below is where a family case begins and ends. What actually happens there is covered in our guide to Scottish family hearings.

Court Questions

Frequently Asked Questions

Which sheriff court will hear my family case?

The one serving where the parties live — normally where the person the action is raised against is based, which for most separating couples means the local court listed above for your area. Where spouses live in different catchments, either court may be competent; your solicitor will confirm the right one, and our local guides name the court for every area we cover.

My town’s court closed years ago — where do cases go now?

To the neighbouring court that absorbed its business. The consolidations most people ask about: Cupar’s cases now go to Kirkcaldy or Dundee, Arbroath’s to Forfar, Haddington’s to Edinburgh, Kirkcudbright’s to Dumfries, Peebles’ to Selkirk, and Duns’ to Jedburgh. The catchments in the tables above already reflect these changes.

Do I have to appear at court in person?

For an undefended divorce, usually not at all — it’s dealt with on paperwork. Where children’s arrangements are disputed, expect a child welfare hearing at which both parents must attend personally. Our guide to Scottish family hearings walks through exactly what happens at each stage.

Does my solicitor need to be based in the same town as the court?

No — any Scottish solicitor can appear in any sheriff court — but local court experience has real value: solicitors who appear weekly before the same sheriffs know how each runs a courtroom and what proposals find favour. That’s why our guides are organised around courts and their catchments, and why the all-firms directory lets you filter genuinely local firms.

Is everything in a family case decided at the sheriff court?

Almost everything: divorce, residence and contact, financial provision, protective orders, adoption. Child protection concerns can also involve the separate Children’s Hearings system — explained in our Children’s Hearings guide — and a small minority of complex cases go to the Court of Session in Edinburgh.
